If it suddenly breaks, go back to the last thing that you did before it broke and start looking there

Make sure the hubs are free, and nothing inside the axle can bind, as nothing goes round in 2wd. The MOT doesn't use 4wd so you don't need fix it before.
If it is still binding and the hubs are free and it is in 2wd you have a big problem.

i know this but i have locked hubs so it all turns even when in 2wd all rotates smoothly then just binds.....really weird

Checked and both cv's are like new and had a detailed feel and its something not 100% in the diff soo what could cause this problem in the diff?

Failed bearing in the diff? Sounds like you will need to pull it out.
